Section 22 (s.22) – Landlord and Tenant Act 1985.
The S.22 allows you to see all invoices/receipts (and other documents supporting the accounts) for the service charge year in question.
A S.22 must be served on R&R within 6 months of you receiving your audited accounts for the last service charge year. Once the 6 months have passed you cannot go in and look at the data behind these accounts.
The Leaseholder has to serve the S.22 and has to collect the data.
The leaseholder can review the invoices for all service charge areas they pay into (parking, building estate, Gym etc). (WARA are not sure if you are allowed to see the Freehold accounts).
Below, you can download a template for serving Section 22. The highlighted areas need to be filled in.
Timings
1- Send in S.22 form within 6 months of the Audited accounts being issued to you.
2- Rendall and Rittner must make the data available to you within 1 month of you serving the S.22.
3- The data must remain available for you to review (normally done by going into RA onsite office) for 2 months.
